Terms of use
These terms govern the use of Festa'm (this website, the app and the organisers' dashboard), owned by Oriol Martí Collell (sole trader), Tax ID 45859350H, c/ Sant Valentí, 2, 4-2, 08221 Terrassa (Barcelona), Spain, oriolmarti2610@gmail.com. By creating an account or publishing content on Festa'm you accept them.
For the public, browsing festivals, saving favourites and sharing your location with friends is free.
What may be published: only real festivals and events open to the public, with truthful information (dates, times and places). Whoever publishes is responsible for the content and for having the right to use the images they upload.
What may not be published: made-up festivals or events, or ones created to promote a business (for example a bar or a venue) or to get visits, or misleading, illegal or offensive content. In those cases Festa'm may delete the festival or the events and suspend the account, without refunding what was paid.
Free cities: in a city nobody has bought, any account may publish the festivals it organises, within the limits of its plan and the extras it has bought. Publishing in a free city gives no rights over that city and no exclusivity.
City licence: a council or an association may buy a city for one year or more, on a quote. For the period paid it has exclusivity: it manages everything published there, its culture groups publish through it and no third-party ads are shown.
When a city is bought, the festivals other accounts have published there may be transferred to the licence holder or unpublished. Festa'm will try to warn the accounts affected beforehand.
Plans, extras and AI credits: plans are bought and paid for online in the organisers' dashboard. Extras apply to a single festival, and each programme page read by AI uses 1 credit.
Payments and subscriptions. Prices: those on the Pricing page, VAT included.
Subscriptions: plans are monthly and renew automatically every month until you cancel them in the dashboard («My plan»). When you cancel, the plan stays active until the end of the period already paid; there are no partial refunds. If you change plans, Stripe prorates the difference on the next invoice.
Extras and AI credit packs: they are one-off payments and are not refunded once applied to the festival or the account. AI credits do not expire.
Billing and invoices: payments are processed by Stripe (Stripe Payments Europe, Ltd., Ireland); Festa'm never sees or stores your card details. Stripe issues the invoices with the tax details you give (name or company name, address and tax ID). If a payment fails, Stripe retries it for a few days; if it keeps failing, the subscription is cancelled and the account goes back to the free plan.
City licences: bought on a quote, outside online payment.
Festa'm may change its prices and these terms; changes are published on this website and do not affect what has already been paid for its period.
These terms are governed by Spanish law. If you are a consumer, you may go to the courts of your place of residence.
